TERMS AND CONDITIONS OF BUSINESS AGREEMENT
FOR THE INTRODUCTION OF PERMANENT STAFF TO BE DIRECTLY EMPLOYED BY
CLIENTS
These Terms and Conditions of Business are between Elite Touch Group Ltd which is the Trading name of Elite Touch Group (hereinafter called the Company) and to the firm receiving these terms attached to an introduction (hereinafter called the Client.).
These Terms and Conditions are deemed to be accepted by the Client by virtue of an interview or the engagement (which term includes employment or use, whether under a contract of service or for services, or under an agency, franchise or partnership agreement) of an applicant introduced by the company.
The Client agrees: -
a) To notify the company immediately when an engagement is accepted and
b) To pay 50% of the fee of the Company either on or before Candidate start date. The remaining 50% balance is then payable 30 days from invoice date (candidate start date). The Company reserves the right to charge interest at 8% of the gross fee for each month (or part thereof) for which the debt remains unpaid beyond the due date. The said payment of 8% will be automatically applied to the invoice when it becomes 7 days overdue unless otherwise agreed.
c) To be aware that if payment is made later than the 14 days, the Company reserves the right to void the rebate period agreed, as set out below, should the Candidate not successfully complete the 10 weeks.
d) The Company reserves the right to withdraw any discount applied to the original fee of where late payments are more than 14 days overdue.
The fee payable to the Company by the Client for the introduction of an applicant is calculated as set out in the accompanying Scale of Fees on the gross remuneration which the applicant is entitled to earn during the first twelve months of his engagement by the Client.
Once an introduction has been made, should the client engage the applicant to the firm for any role at any office within a 12-month period an introduction fee shall be due as set out in the salary band/fee schedule below. Remuneration includes all salary, payments and other taxable emoluments payable to or receivable by the applicant for services rendered to or on behalf of the Client.
Introductions are confidential. The passing on of an introduction to another employer which results in an engagement renders the Client liable to payment of the Company’s fee.
An introduction fee calculated in accordance with these Terms will be charged in relation to any applicant engaged as a consequence of or resulting from an introduction by or through the company, even though the introductions be made indirectly. The term applicant refers to the person introduced by the company to the client, including any member of the company’s own staff.
The company endeavours to ensure the suitability of any applicant introduced to the client. The client shall notwithstanding satisfy themselves as to the suitability of any applicant and/or the company before engaging such applicants. The client shall be responsible for obtaining work and other permits, for the arrangements of medical examinations and/or investigations into the medical history of any applicants and satisfy any medical and other requirements or qualifications required by law.
The company shall not be liable under any circumstances for any loss, damage or expense suffered or incurred by the client arising from or in any way connected with the company to the client of any applicant or the engagement of any applicant by the client.
SALARY BANDS & FEES
Up to £15,000 16%
£15,000 to £24,999 18%
£25,000 to £39,999 20%
£40,000 to £59,000 22%
£60,000 and above 24%
In addition to the above 20% VAT is payable.
